Quadshout Terms of Service

Introduction

By using our Services, you automatically agree to be bound by all these Terms. You are also subject to our Privacy Policy, which governs our collection and use of any information, photos, audios, videos, text and any other materials downloaded, uploaded or submitted to Quadshout (also known as "Content").

By registering, creating an account or clicking "Join", you are agreeing to enter a legally binding contract with Quadshout (even if you are using our Services on someone else's behalf or even if you are just browsing through content not submitted by you.)

If at any time, you wish to end this contract and/or also wish not to be subject to our Privacy Policy, you can do so by closing your account and by no longer using or accessing our Services.

Access to The Services

You are not allowed to use The Services if you are under the age of 16.

To use The Services, you must agree to:

• provide accurate information about yourself.
• create one and only one account.
• use a secure and strong password and not share your password with anyone else.

Under no circumstances will Quadshout be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content.

Quadshout reserves the right to remove and permanently delete your Content from the Service with or without notice for any reason or no reason.

We respect the intellectual and expect users of the Services to do the same. If you believe that anything on the Services constitutes copyright infringement, you may notify us with the details and we will investigate.

What You Cannot Do

Although we do not have any obligation to monitor, screen or edit Your Content, we may use discretion to delete or remove Your Content for any or no reason, including but not limited to violating these Terms and our Privacy Policy. You agree not to:

• impersonate someone or create an account for someone unless they give you the permission to do so.


• defame, harass, threaten, stalk, intimidate, ridicule, abuse or bully other users of the Services.


• promote or discuss anything criminal, unlawful, fraudulent, misleading, discriminatory, injurious or malicious.

• upload viruses or trojan horses, worms, time bombs, cancelbots, malicious code or any software that could disrupt, disable, corrupt or impair the proper working of our Services.


• attempt to obtain passwords or other private information from other users.


• scrape or collect data from the Services or access data you are not permitted to access by automated means or otherwise without our prior permission.


• violate the intellectual property, personal or other rights of others. This violation may include copying or distributing the posts or other content shared by others on Quadshout without their permission.


• copy or download the source code for Quadshout or attempt to reverse engineer or decompile the source code for The Services unless it has been specifically declared as open source.


• make claims of affiliation with or endorsement by Quadshout either by use of the "Quadshout" name, our logo or by any other means.

Rights to Use the Services

Quadshout grants you a personal, non-transferable, non-exclusive, revocable, limited license to use the software that is provided to you by Quadshout. The only purpose of this license is to enable you use The Services as permitted by these Terms.

Quadshout reserves the right to limit your use of the Services at our sole discretion as well as the right to restrict, suspend or terminate your account if you breach these Terms or misuse the Services.

We reserve the right to modify, suspend, dicontinue the Services, either in whole or in part at anytime as we deem fit temporarily or permanently, with or without notice to you. Any future release or update to the Services shall also be subject to these Terms.

Third-Party Content, Promotions or Advertisement

The Services may contain links to third-party websites, products or services ("Third-Party Content"), which we do not have control over and are not responsible for. Using or engaging with Third-Party Content is at your own risk.

There may also be sponsored links to third-party websites, products or advertisements. The type, degree, and targeting of advertisements are subject to change, and you acknowledge and agree that we may place advertisements in connection with the display of any Content or information on the Services, including Your Content.

You should make any investigation you feel necessary before proceeding with any transaction in connection with such Third-Party Content.

Disclaimer and Limits of Liability

No Warranty: THE SERVICES PROVIDED BY QUADSHOUT ARE PROVIDED "AS IS" AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. IN ADDITION, WHILE WE WORK HARD TO PROVIDE THE BEST EXPERIENCE FOR OUR USERS, WE CANNOT AND DO NOT MAKE ANY GUARANTEES THAT THE SERVICES WILL ALWAYS BE SECURE OR FREE FROM ERRORS OR THAT THE SERVICES WILL ALWAYS FUNCTION WITHOUT DELAYS, DISRUPTIONS, OR IMPERFECTIONS. THE FOREGOING DISCLAIMERS SHALL APPLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Limits of Liability: TO THE EXTENT PERMITED BY LAW, QUADSHOUT WILL NOT BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR OTHER INDIRECT DAMAGES, ANY LOSS OF DATA OR INFORMATION AND ALL OTHER LOSSES RESULTING FROM OR RELATED TO THE SERVICE, INCLUDING ANY DEFAMATORY, OFFENSIVE, FALSE OR ILLEGAL.

QUADSHOUT AND ITS AFFILIATES WILL NOT BE LIABLE TO YOU IN CONNECTION WITH THIS CONTRACT FOR ANY AMOUNT THAT EXCEEDS THE GREATER OF ONE HUNDRED U.S DOLLARS ($100).
